3. How we use your data
- To read and respond to your brief or message, and to arrange a discovery call if you would like one.
- To send you a confirmation email after you submit a 5W brief, including a link to our company profile.
- To prepare proposals and deliver services if you become a client.
- To understand which pages and channels are useful to visitors, and to improve the website (only with your consent to analytics cookies).
- To meet legal, accounting or regulatory obligations.
We do not sell your personal data, and we do not send you marketing newsletters unless you separately ask to receive them.
4. Why we are allowed to use it
We process your personal data on the basis of your consent, which you give by ticking the consent box on our forms or by accepting analytics cookies, in line with India’s Digital Personal Data Protection Act, 2023. Where the EU or UK General Data Protection Regulation applies, we rely on your consent and, for replying to enquiries and running our business, our legitimate interests. You can withdraw your consent at any time (see section 8).
5. Who we share it with
We use a small number of trusted service providers to run our website and communications. They process data on our behalf, only for these purposes:
- Google (Google Workspace services such as Gmail, Google Sheets and Apps Script), to store form submissions securely and send emails.
- Hostinger, which hosts our website and our business email.
- Google Analytics and Microsoft Clarity, only if you accept analytics cookies.
- WhatsApp (Meta) and LinkedIn, only if you choose to contact us or share content through them; their own privacy policies apply.
If you become a client and we involve a delivery partner in your project, we will only share what is needed for the work, and only with your agreement. We may also disclose information where required by law.
6. Where your data is stored
Some of our service providers store or process data on servers outside India, including in the United States and the European Union. They use recognised security measures and contractual safeguards to protect it.
7. How long we keep it
We keep enquiries and briefs for up to 24 months after our last contact with you, so we can follow up on the conversation, unless you ask us to delete them sooner. If you become a client, we keep project and billing records for as long as needed for the engagement and as required by Indian tax and accounting laws. Analytics data is kept according to the settings of Google Analytics and Microsoft Clarity, for up to 14 months.
8. Your rights
You can ask us to:
- tell you what personal data we hold about you and how we use it;
- correct or update data that is inaccurate or incomplete;
- delete your data, where we have no legal need to keep it;
- stop using your data, by withdrawing your consent.
Under India’s DPDP Act you may also nominate another person to exercise your rights in the event of your death or incapacity, and, if you are in the EU or UK, you may object to processing and request a copy of your data in a portable format.
To make any request, email info@fivewconsulting.com. We will reply within 30 days. If you are not satisfied with our response, you can complain to the Data Protection Board of India or, where applicable, your local data protection authority.
9. How we protect it
Our website uses an encrypted (HTTPS) connection. Form submissions are stored in an access-controlled account protected by two-step verification, and only the people who need them to respond to you can see them. No system is completely secure, but we take reasonable steps to protect your data and will notify you and the authorities of a breach where the law requires it.
10. Children
Our services are intended for businesses and professionals. We do not knowingly collect personal data from anyone under 18. If you believe a child has sent us their details, please contact us and we will delete them.
11. Changes to this policy
We may update this policy as our services or the law change, for example when we register as a company. The date at the top shows the latest version.
